The lawsuit, filed by David Belniak, 38, of Spring Hill, Florida, demands compensation from the family of dead driver Ray McWilliams, after the 2007 crash. Belniak was jailed for 12 years after admitting manslaughter by crashing into the back of Mr McWilliams’s car at 88mph while they sat at a red light. Cops said Belniak had a blood-alcohol content of .045 – and tested positive for cocaine and Xanax.
