According to a notice of claim filed with the New York City controller, Jose Vargas, a senior at West Side High School, is seeking $10 million in damages for “torn ligaments” and “torn blood vessels” and claims he needs physical therapy.

Vargas’ lawyer, Robert Vilensky, also spoke out. He proclaimed that “The city failed to ensure our safety by neglecting to the upkeep of those gas lines. The city knew those lines were more than one hundred years old. Obviously you can’t have lines that old in today’s infrastructure.”
