37-year-old, Eran Modan, was killed as he attempted to exit an overloaded elevator in luxury apartment building in Brooklyn.

Inspectors say the elevator’s malfunction may have been caused by the amount of people on the elevator. At the time of the accident the elevator was overloaded with 14 people who got on in the lobby. The elevator suddenly dropped to the basement with its doors still open, Modan attempted to jump out but in the same instant the elevator began going back up crushing his body in the process.

Modan, who was caught between the basement ceiling and the elevator shaft, suffered head and body trauma. He was still breathing after the accident, but was pronounced dead shortly after. His body had to be extracted by firefighters.

The victim’s roommate, Mona Ramsdell, was in the elevator at the time of his death. She stood outside of the building yelling to management through tears,

Fix your elevator! Fix everything! If there’s a problem, don’t be lazy. Take initiative because its important!

Records from the New York City Buildings Department show that the elevator had three complaints of being unsafe in 2012 and it has had four violations since 2013, all of which have been resolved.

According to online reports, the doorman in the building said that there is evidence that there may have been a party on the rooftop of the building. He says he will not be using that elevator anymore.
