Back in October, Cuyahoga County prosecutors announced that experts, Kimberly A. Crawford, Supervisory Special Agent of the FBI and S. Lamar Sims, Senior Chief Deputy District Attorney in Denver, found the shooting death of Tamir Rice, 12, was “objectively reasonable.” Here we are in December, and the investigation continues to roll on with the looks of things swaying in the officers’ favor.

Prosecutor Timothy McGinty reveals that the next step in the legal process is for the grand jury to decide whether or not to charge the two officers involved; Officer Timothy Loehmann, the actual shooter, and Frank Garmback, and officer in training.

“The investigation is continuing and ultimately the grand jury will make its decision based on all the evidence,” McGinty said in a statement Tuesday.

McGinty said he released the statements “in keeping with our determination to be as transparent as possible in this and other police use of fatal deadly force cases.”

“With his hands pulling the gun out and his elbow coming up, I knew it was a a gun and it was coming out,” Loehmann said in his statement. “I saw the weapon in his hands coming out of his waistband and the threat to my partner and myself was real and active. Even when he was reaching into his waistband, I didn’t fire. I still was yelling the command ‘show me your hands,'” Loehmann adds. “I shot towards the gun in his hands,” he said.
