Tuesday (February 2) Bill Cosby returned to court for a hearing regarding a promise made to him by former Montgomery County prosecutor, Bruce Castor. According to Cosby’s attorney, Castor promised Cosby would not be prosecuted in the case of Andrea Constand.

If you recall, Cosby was charged with drugging and violating Andrea Constand, a former Temple University employee, at his suburban Philadelphia mansion.

Castor took the stand explaining his reasons for making the deal. He said, “The lack of a prompt complaint and the [consequent] inability to gather forensic evidence from the home or from the person is one piece,” adding, “Contacting a civil lawyer before going to the police department” was another.

Castor continued that he closed the case to remove Cosby’s ability to plead the 5th Amendment in any civil case. He said, “I did not think there was any possibility the case could get better,” he said. “I didn’t believe it [made sense] to go forward with a criminal prosecution, but I wanted there to be some measure of justice.”
