An Oregon death row inmate fighting for his execution is one legal step closer to a lethal injection.

Gary Haugen, a double-murderer who wants to waive all his appeals and head to the death chamber, is mentally competent to make his own legal decisions, according to an Oregon judge.

Judge Joseph Guimond ruled Tuesday that Haugen, 49, can make his own choices in his battle to become Oregon’s first executed prisoner in 14 years.

The judge’s ruling came after a Portland psychiatrist met with Haugen and reviewed his medical records. Richard Hulteng said the killer was rational about his requests for execution.

“He said he was ready,” Hulteng said.

Haugen was convicted in the 1981 rape and beating death of Mary Archer, the mother of his former girlfriend. Twenty-two years later, he killed a fellow inmate in the Oregon State Penitentiary – and was sentenced to die.

Guimond’s decision doesn’t clear all the obstacles to Haugen’s execution effort. Attorneys will meet with the judge on Oct. 7 to discuss Haugen’s future – even as Guimond acknowledged the inmate was disappointed by word of the delay.
