In November, St. Louis County Prosecutor Robert McCulloch announced that a grand jury had decided not to indict Missouri police officer, Darren Wilson. Now one of those grand jurors, known as Grand Juror Doe, has filed a lawsuit against McCulloch, requesting that the state lift the lifetime gag order.

Grand Juror Doe a.k.a. the plaintiff in the lawsuit is being represented by the American Civil Liberties Union of Missouri, and would like to talk speak out about the experience and the ongoing conversation of race relations (a conversation that’s bought out thoughts from Jay Z).

“The Supreme Court has said that grand jury secrecy must be weighed against the juror’s First Amendment rights on a case-by-case basis,” Tony Rothert, legal director of the ACLU of Missouri, said in a statement. “The rules of secrecy must yield because this is a highly unusual circumstance. The First Amendment prevents the state from imposing a lifetime gag order in cases where the prosecuting attorney has purported to be transparent.”

McCulloch has not yet been served with the lawsuit papers, however when he does, he has 21 days to make a formal response.
