Ghostface Wins Iron Man Lawsuit

The landmark case hanging over Ghost Deini’s head for years has finally been settled. Ghostface Killah and Sony Win Iron Man and Supreme Clientele Lawsuit and the ruling sets a precedent for how music compositions of the 60’s and 70’s will be treated from now on…

A New York federal judge granted new favor this past Monday as Ghostface Killah and Sony Win Iron Man and Supreme Clientele Lawsuit–huge for the rap legend who’s modeled not only his Wu Tang Clan alias but much of his music after the Marvel Comics character. Originally having lost to the claims of composer Jack Urbont who said he was the owner of the “Iron Man Theme” sampled twice on the Supreme Clientele album (#classic), the results of the case not only mean a lift in the Hip Hop legend’s pockets but another industry altering change in the letter of music “law.”

Mass Appeal reports Ghostface Killah and Sony Win Iron Man and Supreme Clientele Lawsuit by the gavel of U.S. District Court Judge Naomi Reice Buchwald, who’s decided Marvel is the ‘statutory owner’ of the theme. As a result, composers who’ve created content in what can be considered work-for-hire situations cannot claim rights to samples of their work:

“Marvel’s Stan Lee commissioned Urbont to create music for the 1960s television show The Marvel Super Heroes under a work made for hire agreement. Urbont was paid a fixed sum of $3,000 for the work recording music, but wasn’t granted rights to future royalties. Ultimately, Marvel owns the work and Urbont has no claim to the copyright. Buchwald concluded that “the Iron Man Composition was created at Marvel’s instance because it was developed to Marvel’s specifications and for Marvel’s approval.”

Urbont has filed for reconsideration but it’s looking like the deal is sealed. Ghostface Killah and Sony Win Iron Man and Supreme Clientele Lawsuit is the latest in industry changing law since Universal coughed up $11.5 million to artists for digital royalties last week.
