While we continue to send out prayers to Bobbi Kristina and her family, another one of our favorite celebrities is pulling through a life-altering incident. Eight months ago, Tracy Morgan suffered head and other major bodily injuries due to a Walmart truck driver, Kevin Roper speeding at 65mph in a 45mph zone. Morgan has since left the hospital, and now on his way to a safe recovery. Other than his recovery, Morgan has moved on to file a civil lawsuit against Walmart. However, due to his legal woes – death by auto charge and more – Roper has made an attempt to put a halt on the suit filed, claiming that it effects his possible jail time. No, No, No said U.S. District Judge Michael Shipp .

Roper, who is not a defendant in the comedian’s lawsuit, states that although he’s not a defendant, he’ll still have to testify and because of that, prosecutors in his criminal case would benefit from any information that will be divulged.

According to USA Today:

U.S. District Judge Michael Shipp wrote that a delay would unfairly affect the parties in Morgan’s suit and that Roper didn’t cite relevant case law to back up his claims or give specific examples of how he would be adversely affected. He did give Roper the option to file another motion if information or materials are requested from him for the lawsuit while his criminal case is unresolved.
