Call it a reverse Steven Slater: A New York man was arrested Tuesday for allegedly slapping a Jet Blue flight attendant.

According to authorities, Bryan Garnett, 48, of Utica, was arrested when his flight from West Palm Beach arrived at Boston Logan International Airport.

Garnett is accused of slapping a male flight attendant. But, according to him, he merely pushed the attendant’s hand away as the attendant tried to adjust Garnett’s seat as he slept.

A Massachusetts court declined to hear the case, saying it has no jurisdiction as the incident took place on the ground in Florida, reports the Associated Press.

Prosecutors say JetBlue will have to pursue charges – likely of interfering with a flight crew and assault and battery – in Florida.

According to a JetBlue spokeswoman, the airline wasn’t aware of the decision.
