Derrick Rose’s rape accuser went on a media blitz in her accusation that he and two friends gang-raped her while she was passed out drunk.  Rose and his attorney are now doing their own full-court press, using his accuser’s own friends against her to prove that she is lying and extorting him for money.

Among the defense’s witnesses is Gabriela Chavez, an ex-friend who will tell jurors that the accuser privately admitted she had consensual group sex with Rose and two friends on Aug. 27, 2013.

Rose’s attorneys will also call on co-worker Keyana LaVergne, who will say that the accuser put in a full day of work just hours after she claims she was assaulted, that the woman showed her colleague photos of sex toys on her computer, and texts proving that she wants to obtain money.

Finally, ex-roommate Claudia Carleo will say that she heard no commotion the night of the alleged gang rape and the woman was “smiling” and “happy” the next morning, Rose’s lawyer Mark Baute writes in the brief.

Statement from Gabriela Chavez:

“The plaintiff is someone I view as a fun “party” friend whose overall lifestyle I don’t share – she knows how to party.  For example, she has dated a number of athletes and celebrities, and she is more familiar than I am with the party scene, and ecstasy.  We had a lot of fun in Las Vegas. During the trip to Vegas, the plaintiff told me that she had not heard from Derrick Rose for a while, and she had recently had sex with Derrick and two of his friends — Randall and Allen. She told me she had sex with all three of them, and that she was upset that Derrick was okay with it. At no time did she ever state or claim that Derrick Rose (or his friends) had raped her or done anything non-consensual. Just the opposite: she informed me in her own words that she had partied with them and been with all of them, but all indications were that it was consensual.

In light of my extensive background and training providing services to inner-city communities including abused women, I bluntly asked her if she was raped. She said “no” but that she did sleep with all three men. A month or so later, she told me she was going to sue and that she expected an out of court settlement.”

Statement from Keyana LaVergne:

“I believe Jane Doe’s efforts to extort money from Derrick Rose based on sham allegations is unfair and inappropriate,” the accuser’s former roommate and co-worker, Keyana LaVergne, said in the filing.

LaVergne entered the case after the accuser’s attorney objected to the release of a series of text messages between the woman and the accuser to a basketball website. In the texts, the accuser discusses her financial problems, unemployment and “how I could not let this lawsuit go because of this.”

In court filings, Rose, and later LaVergne, allege the accuser filed the lawsuit against the basketball player because she was upset with Rose over the lack of reimbursement for a sex toy.

  • Doe to LaVergne on October 10, 2015: [discussing joint payments] “Ok lets keep it at 90 then thats 6 months. Lol and i can even pay the whole couch off around xmas my dad gives me money not presents for xmas every year. then u just give me payment and since we finally filed against derrick we soon will be will be returning his tv and ill get us a Plasma.”
  • Doe to LaVergne on October 10, 2015: “I feel bad in many ways for myself and Thomas Brandon and you. I’m the one that kept this lawsuit going and dragged Brandon with me. When I look back at all our conversations via text I told you multiple times my financial situation and how I could not let this lawsuit go because of this.”

Claudia Carleo:

Doe’s roommate who came home in the early morning of August 27, 2013. Excerpts of her deposition will be read into the record including: (1) that she saw no damage to the apartment complex door or her apartment door; (2) that residents had to walk down the hallway to let visitors in; (3) she heard no “noises” or “screaming” or anyone yelling “don’t” or “stop”; and, (4) that Doe was “happy and smiling” the morning of August 27, 2013 before she left for work.

The civil trial will begin on Oct. 4.  Jane Doe is suing Derrick Rose for $21 million.
